These Terms apply to the Myocle website, the Myocle iOS and Android apps, early access programs, app accounts, community features, wellbeing features, AI-assisted tools, app creation services, and all related Myocle services.

1. Introduction

By accessing or using Myocle, you agree to these Terms. Myocle is built as a safer social and wellbeing platform for private reflection, support, growth routines, AI-assisted protection, and positive connection. These Terms also apply to early access testing, app creation service enquiries, investment enquiries, support requests, and any Myocle feature made available through a website, mobile app, email, form, or related service.

2. Eligibility and Age

  • Myocle is designed for users aged 13+.
  • Users under 13 must not create an account unless Myocle later launches a separate parent-managed child product.
  • Users under 18 should use Myocle with parent or guardian awareness, supervision, or consent where required by law.
  • Parents and guardians are responsible for supervising minors where legally required.

3. Not Medical, Emergency, Crisis, or Clinical Care

Myocle is a wellbeing and social support platform. It is not a replacement for emergency services, medical advice, therapy, counselling, diagnosis, crisis support, psychiatric care, addiction treatment, eating disorder treatment, or professional healthcare.

If you are in danger, may harm yourself, may harm someone else, or need urgent help, contact local emergency services or qualified crisis support immediately. AI Bodyguard, Content Sanitisation, Monkey, Coach, PGIS, Panic Button, Geolocator, Trusted Contacts, and other safety tools are supportive tools only and must not be relied on as an emergency response system or professional care service.

4. Account Registration and Security

You must provide accurate information when creating or using a Myocle account. You are responsible for keeping your password, login credentials, devices, and account access secure. You are responsible for activity that occurs through your account unless caused by Myocle's own systems or unlawful access beyond your reasonable control. Myocle may suspend, restrict, or terminate accounts that are misused, unsafe, unlawful, or in breach of these Terms.

5. Acceptable Use

You must not use Myocle to create, share, encourage, facilitate, or promote:

  • bullying, harassment, threats, stalking, hate speech, abuse, intimidation, or targeted humiliation;
  • sexual exploitation, grooming, child sexual abuse material, or any sexual content involving minors;
  • self-harm encouragement, suicide encouragement, eating disorder encouragement, drug abuse encouragement, or violence;
  • illegal activity, impersonation, scams, spam, scraping, unauthorised automation, hacking, malware, or security attacks;
  • reverse engineering, bypassing access controls, bypassing moderation, or attempting to defeat AI Bodyguard, Content Sanitisation, reporting, or safety systems;
  • misuse of Panic Button, Geolocator, Trusted Contacts, support sharing, or other safety tools.

6. Community Features

Community features may include Friend Zone, Glow Up Wall, support sharing, trusted contacts, family support, comments, messages, reactions, reports, and other social tools. You are responsible for what you share. Myocle may moderate, hide, restrict, remove, preserve, or report content or accounts where needed for safety, legal compliance, abuse prevention, or platform integrity.

You must not rely on community users for emergency help. Community support can be valuable, but urgent risk requires emergency services or qualified support.

7. AI Tools and Automated Support

Myocle may use AI-assisted tools including AI Bodyguard, Content Sanitisation, Coach, Monkey, PGIS recommendations, automated moderation, summaries, safety prompts, and guidance. AI can be wrong, incomplete, delayed, or unsuitable for your situation. AI output is not professional advice and must not be relied on for emergency, clinical, medical, legal, financial, crisis, or high-risk decisions.

8. PGIS and Progress Signals

PGIS is a Personal Growth Intelligence System designed to support reflection, routines, motivation, and wellbeing progress. PGIS scores, signals, prompts, recommendations, and indicators are motivational and reflective only. They are not medical scores, diagnoses, clinical assessments, measures of personal worth, or guarantees of improvement.

9. Monkey Companion

Monkey is a virtual companion designed for comfort, encouragement, positive reinforcement, and emotional support. Monkey growth and reactions may be linked to meaningful wellbeing activity, not to your personal worth. Monkey is not a clinical assessment, diagnosis, punishment, or judgement of you as a person.

10. Coach Guidance

Coach may provide structure, habits, routines, accountability, and next-step guidance. Coach does not replace a qualified professional and should not be treated as medical, therapeutic, counselling, clinical, legal, financial, or crisis advice.

11. User Content

User content may include journals, reflections, mood entries, goals, routines, posts, profile content, photos if enabled, messages if enabled, community updates, Vault content, support sharing, and other material you submit or create.

  • You own your own content, subject to any rights others may have in material you include.
  • You grant Myocle a limited licence to host, store, process, display, transmit, moderate, back up, and use your content only as reasonably needed to operate, secure, improve, and support the service.
  • Private Vault, journal, and reflection content remains private unless you choose to share it, your settings trigger sharing, or disclosure is required or permitted for legal, safety, security, or serious-risk reasons.
  • Harmful, illegal, abusive, exploitative, or unsafe content may be removed, restricted, preserved, or reported.

12. Privacy, Data, and Account Deletion

The Privacy Policy explains how Myocle may collect, use, store, protect, disclose, retain, and delete personal information. The Privacy Policy forms part of these Terms. Users can request account deletion and associated data deletion through the Data Deletion page or by contacting myoclewellness@gmail.com.

13. Location and Safety Tools

If location tools are enabled, location sharing is optional and controlled by available app settings. Location data may be inaccurate, delayed, unavailable, or affected by device settings and network conditions. Geolocator, Trusted Contacts, support sharing, and related safety tools are not a replacement for emergency services. Choose trusted contacts carefully.

14. Panic Button and Urgent Support

Panic Button is a support pathway, not a guaranteed emergency response system. Myocle cannot guarantee immediate response from third parties, trusted contacts, platform users, or external services. In urgent danger, contact emergency services directly.

15. Payments, Subscriptions, and Purchases

Myocle may introduce paid features, subscriptions, in-app purchases, app creation services, or premium tools. Pricing and key purchase terms will be shown before purchase where applicable. If purchases are made through Apple App Store or Google Play, payment, subscription management, cancellation, and refund processes may be handled through the user's app store account and the applicable platform rules.

16. Apple App Store and Google Play

You must also follow applicable Apple App Store, Google Play, device, payment, and platform terms. Apple and Google are not responsible for Myocle content, services, support, or user-generated material except as required by their own platform terms or applicable law.

17. App Creation Services and Enquiries

Myocle may receive enquiries for websites, apps, prototypes, investor packs, automation, launch assets, and related digital services. Sending an enquiry does not create a contract, partnership, employment relationship, investment agreement, or obligation to provide services. Paid work requires a separate written agreement. App creation services are separate from Myocle user accounts and app wellbeing features.

18. Intellectual Property

The Myocle name, Myocle Wellness name, logos, Monkey, Coach, PGIS, AI Bodyguard, app design, website, copy, visual assets, icons, source boards, workflows, prompts, directives, concepts, systems, and related branding are owned or controlled by Myocle / Stuart Cross unless otherwise agreed in writing. You must not copy, reproduce, modify, sell, publish, scrape, imitate, reverse engineer, or commercially use Myocle brand assets, content, designs, systems, or workflows without written permission.

19. Suspension and Termination

Myocle may suspend, restrict, or terminate access where there is a safety risk, misuse, illegal activity, harmful conduct, breach of these Terms, abuse of users or the platform, account security concern, or attempt to bypass safety systems. Myocle may also remove or restrict content where needed for moderation, safety, legal compliance, or service integrity.

20. Service Availability and Liability

Myocle is provided on an as-is and as-available basis. Myocle does not guarantee uninterrupted access, error-free operation, perfect moderation, specific wellbeing outcomes, account recovery, data availability, third-party response, app store availability, or that all harmful content will be detected before it is seen.

To the extent permitted by law, Myocle is not responsible for user-generated content, third-party actions, app store outages, third-party services, user misuse, device failures, network issues, or losses arising from reliance on non-professional support. Nothing in these Terms excludes, restricts, or modifies rights, guarantees, remedies, or liabilities that cannot be excluded under the Australian Consumer Law or other applicable law.

21. Indemnity

You agree not to hold Myocle responsible for claims, losses, costs, or liabilities caused by your misuse of the service, unlawful content, harmful conduct, breach of these Terms, infringement of rights, misuse of safety tools, or third-party claims arising from your actions.

22. Changes to These Terms

Myocle may update these Terms as the website, app, safety systems, legal requirements, or service model changes. Updated Terms will be posted with a revised date. Continued use of Myocle after an update means you accept the updated Terms.

23. Governing Law

These Terms are governed by the laws of Australia and the applicable laws of the Australian state or territory connected with Myocle's business operations, unless mandatory consumer laws provide otherwise.
